Terms of Service

1. Purpose

These Terms govern access to the Traaker platform (the « Platform ») operated by HORIZON AI, a French SAS with share capital of €1,000, registered office at 35 avenue Marcel Dassault, 31500 Toulouse, France, registered with the Toulouse Trade and Companies Register under number 104 720 388 (the « Provider »), and the subscription by any legal entity or natural person acting in a professional capacity (the « Customer »).

2. Sign-up and account

Sign-up is done online, by work email or via a third-party identity provider (Google). A work email address is required; personal or disposable addresses may be rejected. The Customer provides identification information, accepts these Terms and the Privacy Policy, and confirms their email address. The Customer is responsible for keeping their credentials confidential.

3. Plans

The Platform is offered under five plans: Basic, Pro and Elite (self-serve), Enterprise (custom quote) and Agency (usage-based, billed in credits). Each plan's features and quotas are listed on the Pricing page. The Customer may change plans at any time from their account; an upgrade takes effect immediately (prorated), a downgrade at the end of the current period.

4. Free trial

The Basic plan includes a 7-day free trial, with no payment card required at signup. When the trial ends, access to billed features is suspended until a subscription is taken out. The Pro and Elite plans have no trial and are billed from signup. The Agency plan includes a trial allowance of 100 free credits, with no time limit, consumed like any other credit (section 6).

5. Subscription and billing

Billing is monthly or annual at the Customer's choice (the annual option being billed in advance). Payments are processed by Stripe; no payment card data is stored by the Provider. Depending on their plan, the Customer may purchase quota extensions (e.g. additional prompts, competitors, brands or users) that are added to their subscription, billed recurrently, and cancellable at any time effective at the end of the current period, with no refund of the period under way.

6. Credits (Agency plan)

The Agency plan is usage-based: each action (audit, AI query, report…) consumes a number of credits shown in the application. Two types of credits coexist:

  • Subscription credits: a monthly allocation renewed at each billing period. Unused subscription credits at the end of the period expire and are neither carried over nor refunded.
  • One-shot credits (packs): purchased on a one-off basis, they do not expire while the account is active.

Actions are first deducted from the current period's subscription credits, then from one-shot credits. The balance is viewable at any time in the application. No refund, full or partial, is granted for unused credits.

7. Termination

The Customer may cancel their subscription at any time from their account. Cancellation takes effect at the end of the current billing period; no refund, full or partial, is granted for the unelapsed portion of the period or for unconsumed credits. A trial account that is not converted and not used may be deleted after the trial period ends.

8. Customer obligations

The Customer agrees to use the Platform in compliance with these Terms and not to harm its integrity. Automated account creation, bot usage, scraping, or any abuse of service is prohibited.

9. Intellectual property

The Platform, its code, brand and all its content are the exclusive property of the Provider. Data entered by the Customer remains the property of the Customer.

10. Personal data

Personal data processing is detailed in the Privacy Policy. Data is hosted in Europe and GDPR-compliant. Audit and content data may be retained for a period depending on the plan, then archived or deleted.

11. Liability

The Provider commits to a best-efforts obligation. Its liability is capped at the amount paid by the Customer over the twelve months preceding the triggering event.

12. Governing law and disputes

These Terms are governed by French law. In case of dispute, jurisdiction is granted to the courts of the Provider's registered office, subject to mandatory applicable provisions.
